State Highway Access Permit Page 1 <br />Attachment to Permit No. 103039 -Additional Terms and Conditions <br />A Notice to Proceed, CDOT Form 1265, is required before beginning construction of the access or any activity <br />in CDOT Right-of--Way. All submittals, documents, plans and other items that must be completed, shall be <br />submitted and approved before a Notice to Proceed for construction will be issued. Contact the Department <br />for the Notice to Proceed. <br />2. If there are any questions regarding this permit, please contact Chuck Binford, CDOT Access Manager, at <br />303-757-9123. <br />3. Incorporated as part of this permit will be the following: <br />Application for Access Permit (CDOT Form No. 137} <br />The Permit (CDOT Form 101) and its two page attachment (CDOT Form lO1B) <br />Notice to Proceed <br />Construction Plans <br />Signing and Striping Plans <br />Certificate of Insurance (To be submitted to CDOT prior to beginning constmcfion in CDOT Right-of--Way) <br />4. If necessary, minor changes, corrections, and/or additions to this permit maybe ordered by the Department <br />inspector, other Department representives or local authority to meet unanticipated site conditions. Changes <br />may not be in violation of the Code. <br />5. Left tum movements in and out of this access may be prohibited at some future date. <br />6. This access shall be used only for commercial purposes with the vehicular volume using the access during the <br />Peak Hour not to exceed 15 vehicles per hour. <br />7. This access permit is not valid unless the proposed use is approved by Gilpin County. <br />8. The Permittee is responsible £or obtaining any necessary additional federal, state, and/or city/county permits or <br />clearances required for constmction of the access. Approval of this Access Permit does not constitute <br />verification of this action by the Permittee. <br />9. The Pemuttee shall provide the Department and /or the issuing authority with the following information prior <br />to commencement of any construction activifies beyond the existing curb and gutter or paved area, within <br />CDOTRtght-of--Way: <br />A, Written clearances for Threatened or Endangered Species. <br />B. Wetlands clearances. <br />C. Archaeological and Paleontological cleazances. Any discoveries shall be mitigated in conformance with <br />section 107.23 of the standard specifications for road and bridge construction, latest edition. A surface survey <br />must be performed and a written clearance provided to the Department and/or issuing authority prior to <br />commencement of any constmction. <br />It is the responsibility of the Pemuttee to assure that no such sites aze present prior to commencement of <br />construction activities. All identified sites shall be mitigated to the satisfaction of the appropriate agency prior <br />to proceeding with work activities. <br />Wetland mitigation shall be completed in conformance with the policies, procedures and regulations of the <br />Army Corps of Engineers, Federal Highway Administration and the State of Colorado, as maybe applicable. <br />10. All costs associated with the installation of this access are the responsibility of the Permittee. This includes <br />the design, construction, utility relocations, testing of materials, and inspections. <br />11. Any work within CDOT Right-of--Way shall begin after 8:30 am and all work and equipment shall be off the <br />
