There is
only one archaeological site in question. There are two cultural
properties within the confines of Mr. Stone's application area
but only one of these, site 5MT2020, is defined as a site and is
prehistoric in nature. The other resource is a historic can dump
and is not considered to be a site nor significant. The second
point of information regards the "alleged" disturbance of this
sire by Mr. Stone's surface testing. Our field investigations at
the site and presence during excavations of test pits in the
vicinity of the site revealed no damage to elements of the site
that might contribute to it's significance as defined under
federal statute.
As there do not appear to be provisions within the state
regulations that deal directly with ascertaining the concerns of
Native Americans regarding operations under your jurisdiction, we
feel that you should at least be aware of the concerns expressed
to us. We feel that we are or will be addressing the interests
of the Hopi Tribe regarding consultation about data recovery at
5MT2020 at some time in the near future. However, we do not feel
that we have an option to preserve this site in place (should
they ask us to do this) without unduly impacting Mr. Stone's
legal rights as the mineral owner.
c;:,..,:~rt:a C:;:~.,
`r''OJY
~~
0
rn C~7
rn ~
T N
m o
w
u_
i
