Typically, the e are areas sloping at no mare than about 5:1 from the shoreline to some dista ce into the lake. Please clarify your position in this matter. 2. Water Resources - Have you clarified the situation concerni g water rights relative to the exposure of ground water to produce ponds i reclamation? If not, I suggest that you do so. Exhibit E - 1. Our staff hydrologists do not necessarily agree with your a alysis of the immediacy of river destruction of the pond banks closest to th river. Given the fact that these ponds are located 100' from the active r ver channel and protected by sand banks, 1;he ponds may be expected to remain f r sometime. Since the end land use is rangeland and (given the ex is ence of the pond) wildlife habitat, revegetation of all non-lake areas is requ red by Rule 6. Please commit to the revegetation of all such areas. 2. Our staff vegetation specialists concur with your revegetat on plan, but I again question the lack of salvage of topsoil (or finer-grai ed growth medium). Please justify this matter further. Walker Pit North Exhibit A - An examination of the vicinity map shows that part of he permit area appears to lie in the NEl/4 SEl/4 of Section 33. This areas ould also he referenced in the legal description. Exhibit D - Water Resources: How is Clay Creek to be rose? Is a ~ulvert planned? Exhibit F - Does the special use permit apply to areas with the Section 33, as well as the other area referenced? Walker Pit South I/4 SEl/4 of My review shows that the application for this pit is adequate now.
