OFFICE OF BUDGE' <br />TERRYA.HART <br />COUNTY ATTORNEY <br />Please bey advised that this Department received a complaint on September 25, 1997, <br />alleging that the Mining operation on 36`" Lane is being operated in violation of the <br />conditions imposed upon the approvals of said facility. The aforementioned facility was <br />granted Special Use Permit No. 709, most recently reviewed and approved on <br />September 24, 1994. The complaint alleges that gravel-hauling trucks from your facility <br />are travelling 36'" Lane during school hours (between 7:30 and 8:30 A.M. and 2:30 and <br />3:30 P.M.I. Broderick and Gibbons was granted Special Use Permit No. 709 on <br />September 25, 1990. The permit was approved at subsequent one-year reviews on 9- <br />24-91 (12 conditions of approval), 9-22-92, 9-30-93, and again on 9-27-94 (with 10 <br />conditions of approval). The allegation, if true, would constitute violation of the 9-27-94 <br />approval, ~:,ondition No. 9, which states: <br />11. The applicant's haul trucks shall not operate on the haul route (see <br />condition iVo. 5) between 7:30 AM. and 8:30 A.M. and 2:30 P.M. and 3:30 P.M. <br />during school days. This condition applies to the truck independent of whether <br />they are empty or loaded. This condition does not provide for the use of a <br />secondary or alternate haul route to be used. <br />Staff consiliers this alleged violation extremely serious as it endangers the lives of <br />school children within Pueblo County.
