The application cannot be approved until the following issues are adequately addressed. Please submit <br />a response to the following issues as soon as possible, but no later than May fi, 2004 so the decision due <br />date set for May 14, 2004 can be met. If you cannot respond by May 6, 2004 please submit a written request <br />for extension of the decision date. If your response, or an extension request, are not received by May 6, 2004 <br />this application may be denied. <br />ADEQUACY ISSUES <br />Exhibit A -Legal Description <br />1. Please revise the legal description starting point reference from the SW corner of section 1 to the SE <br />corner of section 1. <br />Exhibit B -Site Description <br />2. The list of structures and their owners appears to be missing the county shop and it appears that <br />there may be a small structure just east of the pump house owned by Dustman. Additionally, <br />some of the buildings on the Carlill property are located very close to the 200 foot mark from the <br />permit area. Please verify, on the ground, that these structures are in fact over 200 feet from the <br />proposed permit boundary. <br />3. The maps indicate that the county shop is located on property owned by Farnsworth. Please <br />verify that this is the case or correct the property boundary lines and notations. <br />4. Please include, on Map B-1 a notation of who the owner is for the parcel located directly east of <br />the northeast proposed permit boundary corner. If this parcel is owned by a party who has not <br />yet been notified, please send the required notice to this party. <br />5. The parcel referred to in item no. 4 above has a pond located within 200 feet of the proposed <br />mine site. It is reasonable to believe this pond may be dewatered by the pit dewatering. Please <br />address this concern by indicating how dewatering of this pond will be avoided, or submit that <br />landowners approval to dewater this pond. <br />Office of Offce of ~ Colorado <br />
