REMEDIAL COMPLIANCE PLAN <br />The existing spillway configurations are inadequate for a permanent impoundment. <br />Therefore, Peabody proposes the following remedial actions to be implemented pending CMLRD <br />approval: <br />1. Replace existing 24" Ci1P with a proposed 24" ChIP with anti-seep collar to the <br />line and grade as shown on Exhibit 7-18. <br />2, P.eplace existing v-shaped emergency spillway v+i th proposed trapezoidal channel <br />as depicted on Exhibit 7-18. <br />3. Raise the embankment to the line and grade as shown on Exhibit ~-18. <br />4, Install a fence to maintain safe access to the impoundment area. <br /> <br />All material excavated from the spi llv+ay and adjacent areas, as a result of the above <br />remedial action, v+i 11 he placed in one of the following locations as determined by <br />Peabody's field engineer during construction: <br />1, If the engineer determines the material to be suitable for embankment material, <br />the material will be placed and compacted within the slopes of the embankment. <br />2. If the material is excessive or not suitable for use within the slopes of the • <br />embankment, the material will be placed outside the plane of the slopes on the <br />downstream side of the embankment, graded into the surrounding topography, and <br />reclaimed in accordance with Peabody'S reclamation plan. This excessive <br />material will increase the stability of the embankment by increasing the <br />overall width, flattening the downstream slopes, and/or reducing the downstream <br />embankment height. Based on the field conditions encountered at the time of <br />construction, the field engineer is allowed enough flexibility to dispose of the <br />material in an acceptable manner. <br />Embankment reconstruction will be conducted in compliance with CMLRD regulations. the <br />existing embankment v+i 11 6e cleared of all organic matter prior to the placement of :iew <br />fill material. The placing and spreading of fill material will proceed `rom the lowest <br />point on the embankment in horizontal lagers of such thickness as to allow for a minimum <br />compaction of 93 percent of the standartl proctor.
