<br />Division of Minerals and Geology <br />9 November 2000 <br />Page 4 <br />no significant changes in water levels are observed, and quarterly thereafter until <br />mining ends or "steady state conditions" are realized. <br />Continued observations afer completion of mining at the facility will be proposed <br />after final options are determined for reclamation of the facility. <br />4. No groundwater will be exposed without approval of the Substitute Supply Plan and a <br />gravel pit well permit by the Office of the State Engineer. Evidence of acourt-approved <br />augmentation plan for fmal reclamation requirements will be provided to DMG prior to <br />requesting financial warranty release. <br />Exhibit S -Permanent Structures <br />1. As you noted in the pre-operational inspection, conducted August 18, 2000, the Greeley <br />Truck Washout facility, which is within 200 feet of the proposed disturbance, was not <br />shown on the mining and reclamation maps. New Exhibit D and Exhibit F maps, showing <br />the Greeley Truck Washout facility are submitted herewith. <br />Enclosed are agreements that the applicant has obtained with the following owners of <br />structures within 200 feet of the proposed disturbance: <br />City of Greeley, regarding water and sewer lines, East 8'" Street and Ash Avenue. <br />Public Service Co., regarding power pole and transmission line. <br />U. S. West, regarding underground telephone cable. <br />Ed Duggan regarding steel shed and access road. <br />Greeley Washout, Inc. regarding office structure. <br />The applicant has also submitted agreements to the following: <br />Colorado Department of Transportation, regarding Highway 263 <br />Ogilviy Ditch Company <br />Greeley Gas Company <br />The applicant will commit to preserving a minimum 200-foot setback from a structure <br />until such time as the applicant receives an executed agreement from the structure <br />owners. Should the applicant be unable to reach an agreement with a structure owner, <br />the applicant will provide an appropriate engineering evaluation that demonstrates that <br />such a structure shall not be damaged by activities occurcing at the mining operation, and <br />will maintain the minimum 200-foot setback until such time as the study is completed and <br />submitted to the Division of Minerals and Geology for its review and comment. <br />\\DENkammon\PROI ECTS\20367 Greeley\Response aTech Rev2.Aac <br />
