18905 Ward Creek Road <br />Cedaredge, CO 81413 <br />February 18, 2005 <br />Re: SDOS-001 Benson Brothers -Red Canyon <br />Surface Creek Area Planning Committee <br />501 Palmer Street <br />Delta, CO 81416-1764 <br />Deaz Surface Creek Planning Committee: <br />The Benson Brothers proposal to none red rock shale in Coalby Canyon directly <br />contradicts the goals and policies of the Delta Coun Master Plan and the Delta County <br />Regulation for Specific DeveloQments, Accordingly, the Area Planning Commission <br />(APC) should recommend denial of this application. <br />As the first step in Delta County's review process the APC provides the opportunity for <br />public input which your committee can then evaluate in terms of the Regulations for <br />Specific Developments and the Master Plan as a basis for making your recommendations <br />to the Delta County Planning Commission. <br />The Regulation for Specific Development states; <br />Section 4. Purpose. It is the intent of the Board of County Commissioners of Delta <br />County to plan for specific developments within the unincorporated area of Delta <br />County to: <br />A. Promote the health, safety, and general welfare of the present and future <br />residents of Delta County. <br />B. Manage changes to specific development that may or may not have an adverse <br />effect on neighboring landowners and other residents of Delta County. <br />C. Achieve the goals and implement the policies of the Delta County Master P-an, <br />especially to: <br />1. Preserve and proteM property rights. <br />2. Preserve and protect the natural and cultural resources of Delta County <br />including, but not limited to wildlife, riparian areas, wetlands, sensitive lands, scenic <br />byways and areas of significant scenic value. <br />3. Preserve the character of the existing rural and urban communities and <br />neighborhoods in Delta County. <br />4.... <br />5. Preserve the agricultural land and agricultural lifestyle and promote the <br />agricultural economy of Delta County. <br />Specific goals and policies of the Delta County Master Plan that apply to the review of <br />the Benson Brothers application are: <br />Goal I.
