idea of compromising the health of Coalby Canyon residents would be neglegent. <br />The impact of the proposed Rock Quarry would be so severe that <br />satisfactory mitigation is not possible. There are presently new Coalby <br />valley subdivisions before the county commissioners, and this area continues to <br />grow, with new residences. This quiet residential nieghborhood and a loud Rock <br />Quarry are extremely incompatible. <br />In addition to this, the Benson Rock Quarry Application is <br />incompatible with point B on page 9 of the Delta Couny Master Plan, drafted <br />October 1996. Point B states: <br />"The right to develop and improve private property does not constitute the <br />right to physically damage or adversely impoact the property or property value <br />of neighboring landowners " <br />!n the Benson's Rock Quarry Application, they have provided an <br />ariel map of Coalby Canyon, which was taken in 1994, but they have written <br />January 25, 2005, at the top of this map (same piece of paper). The 1994 map <br />which they have provided was made before several of the houses south of the cliff <br />were built, The fact that this map was labeled with a false date brings into <br />question the integrity of the entire application. Perhaps the committee <br />could revue the truthfulness of this application. Without a current map, <br />including houses that exist in 2005, the year of the application, the Rock Quarry <br />Application should tie denied. <br />There is a vineyard south of the Benson property. According <br />to vineyard specialists, the grapes would be negatively affected by any type of <br />dust, thus causing economic hardship to the vineyard owner. Again, I refer <br />to point B on page 9 of the Delta County Master Plan (drafted October 1996): <br />"The right to develop and improve private property does not <br />constitute the right to physically damage or adversely impact the property or <br />property value of neighboring landowners." To remain consistent with this Delta <br />County Master Plan, this application for a Rock Quarry by the Bensons should be <br />denied. <br />Also, the Bensons have not demonstrated compliance with these <br />regulations, according to Section 8, page 2 of Delta County Regulation for <br />Specific Developements. Section 8 of this document states: "The burden of <br />demonstrating complicance with these regulations, including the responsibility to <br />submit complete and accurate application materials, rests with the applicants." <br />Benson Brothers has not demonstrated compliance with Delta County <br />Regulations, nor have they submitted complete and accurate materials, in their <br />application. Much information has been omitted, including the numerous houses <br />close to the proposed Benson Quarry site (as seen in their mislabeled Coalby <br />Map), and discription of the Benson property as "remote". To disregard the <br />welfare of Coalby Canyon residents, would be negligable. <br />In addition to this, abundant wildlife lives in Coalby Canyon. <br />On the Benson property, including the Sandstone Cliff area, these animals have <br />been sighted by area residents: Mountain Lions <br />Bob Cats <br />Bald Eagles (they are known to nest on cliffs) <br />Turkey Vultures (an endangered species) <br />Elk <br />Mule Deer <br />The Division of W ildlife has been contacted to report a <br />possible violation of the habitats of the wild animals listed above. These wild <br />animals would be displaced and endangered if the proposed Rock Quarry were to <br />be approved. <br />We respectfully request that the Application by Benson <br />Brothers for a Rock Quarry in Coalby Canyon be denied. Thank you. <br />
