The Master plan states that, °development adjacent to agricultural operatons may <br />have to be denied or required to mitigate adverse impacts on existing agricultural land use". iF the <br />Board of CauMy Commissioners chooses to approve and aNow this Proposed gravel pit in this <br />area, Planning Staff proposes the fallowing Ihst of items to assist to mitigation of the adverse <br />impacts on the cunen2 land use by increased traffic, dust, noise, and other items as listed that <br />have been raised at the public meetings twt Staff feels have not been adequately addressed. <br />Therefore, approval of this devebprtrent would be subject to the following condHions at the <br />expanse of the developer: <br />1. Provide dust control through the use of water misters on aR oquipmerrt incuding but not <br />limited to; bulldozers, crushers, baCkhoes, trucks, excavators, and loaders. <br />2i Provide a water misting system an alt ridge tines to mitigate fugtive dust from exiting the <br />mine site. <br />1i. install industrial mufflers on all equipment including but not Iknited to; bulldozers, <br />crushers, backhoes, trucks, excavators, and loaders. <br />~ Install distance activated back-up alarms an ail applicable equipment. <br />5. The use of portable generators wauki net be allowed. <br />6. Restrict the hours of operation to 8:30 to 5:30 Monday through Friday witty no work <br />allowed except equipment maintenance on ail legal holidays and weekends. <br />7. Locate die crusher within a closed structure to limit the otf-alts noise. <br />8. Bring the paved road to be used for access tq the site from Ward Creek Road up to <br />County standards and maintain the road in that condition throughout the life of the project. <br />9. Provide a "T" intersection with a right hand passing lane and a right tom lane on Ward <br />Creek Road as illustrated in exhibk A. A rrorfh bound aacel lane may txa required after <br />review by the County Engineer. <br />10. Post a sign on Ward Greek Road indicating that trucks are fuming onto the road Werth of <br />the access rnad to wam approaching motorist <br />11. Establish an Escrow Axount with the Delta County Treasurer to collect 3 cents/ton of <br />crushed gravel to a maximum amount that wl0 be determined by the District Road <br />Foreman to cover the cost of any damage done to County roads during hauling <br />operations. The escrow account shall be an interest bearing account in the name of the <br />operator. property owner, and Delta County <br />12. Provide a mitigation plan acceptable to adjacent agricultural operations in the event that <br />crops are affected by fugitive dust <br />13. Provide to the County a mining plan that indicates which areas will tie initially mined and <br />then subsequently mined throughout the life of the mine and a reclamation plan that <br />shows how the visual impacts will be mRigated with a timeframe for the reclamation. <br />14. All outside lighting shall txt hooded. <br />15. Submit a Weed Mitigation Plan to the Delta County Weed Coordinator for approval prior <br />to beginning operations. <br />1$. Provide copies of alt State permits required by the Division of Minerals and Geology to <br />Delta County prior to commencing operations. <br />17. Provide copies of alt State permits required by the Coorado Department of Health and <br />Environment to Delta County prior to commencing operations. <br />18. Provide copies of all permits required by the Mine Safety aru! Health Administration to <br />Delta County prior to commenrarg operations. <br />19. Provide a copy of the State of Coorado Storm Water Management Plan to Dana County <br />prior to cemmencing operations. <br />20. Provide a copy of the Well Permit issued by the State of Colorado to Delta County as well <br />as the change in use approval from the domestic weN status to cnmrnercial status prior to <br />commencing operations. <br />21. FM reYaii sales witl be allowed at the mine location. <br />22. Chemical toilets will 6e allowed on-silo for employee use and shall be maintained by a <br />licensed Delta County Contractor. <br />23. No operation will occur on windy days. <br />24. Provide to Delta County a sRe plan showing the location of the berms to be constructed to <br />mitigate sound and fugitive dust. <br />25. Provide to the Delta County Commissioners a yearly report an the effectiveness of the <br />
