February 15, 2005
Attn: Surface Creek Area Planning Committee
Deka County Planning Commission
Ref: Mining application by Benson Brothers Quarry
Commissioners:
It has come to our attention that Benson Brothers QuanS currently has before you an
application for a newly proposed mining operation, application SDOS-001, in Coalby
Canyon. In March 2000, we purchased 37 acres of land on top of what is known as "Dry
Mesa" located at 18002 Wazd Creek Rd. At the time of ow purchase, this acreage was
raw drrt chosen for its spectaculaz views and serenity. Since purchasing this land we have
made vast improvements with the intent of living there in the near future. These
improvemeMS include drilling a well, laying over 1600 feet of water pipe from that well,
bringing electricity to the top of the mesa via 12 power poles, finishing 500 feet of road
into ow property, creating an entrance structure, and constructing a 30 X 40 two-story
building complete with a 1500 gallon septic system. Most assuredly, the investment
decision we have made concerning ow property represents a large financial commitment
on ow part for our future in Delta County.
We are completely and adamantly opposed to the proposal by the
Benson Brothers to relocate their quarry closer to our property. If their
applicafion were to be approved and this quarry were to be established, ow property
values would most definitely decline, due to the destruction of visible landscape,
increased truck traffic on Slaughter Grade and Ward Creek Rd., noise and air pollution
caused by generators, blasting, machinery, and dust as well as the very teat possibility of
adverse effects on our water source supplied by Red Canyon spring/Ward Creek.
Over the course of the neat several weeks, many residents in the area of this proposed
operation will be contacting you in both verbal and written form. After completely
understanding the effects this new quarry would have on ow county's environment and
the concerns of its residents, we strongly request you deny the Benson Brothers'
application SDOS-001.
Sincerely,
Jerry and Judy Weaver, owners
18002 Ward Creek Rd.
Cedaredge, Colorado
Current address: 516 Winn Rd.
Salina, Kansas 67401
Home Phone: 785-825-9045
Email: pweaver@cox.net
