There are presentty new Coalby valley subdivisions before the county commissioners, and this area continues to grow, with new residences. This quiet residential nieghborhood and a loud Rock Quarry are extremety incompatible. In addition to this, the Benson Rods Quarry Application is incompatible with point B on page 9 of the Delta Couny Master Plan, drafted October 1996. Point B states: "The right to devebp and improve private property does not constitute the right to physicalty damage or adversely impcect the properly or property value of neighboring landowners." In the Benson's Rock Quarry Application, they have provided an ariel map of Coalby Canyon, which was taken in 1994, but they have written January 25, 2005, at the top of this map (same piece of paper). The 1994 map which they have provided was made before several of the houses south of the cliff were built. The fact that this map was labeled with a false date brings into question the integrity of the entire application. Perhaps the Comm~tee could revue the truthfulness of this appliption. Without a current map, including houses that exist in 2005, the year of the appligtion, the Rock Quarry Application should be denied. There is a vineyard south of the Benson property. According to vineyard specialists, the grapes would be negativety affected by any type of dust, thus causing economic hardship to the vineyard owner. Again, I refer to point B on page 9 of the Delta County Master Plan (drafted Ocoober 1996): 'The right to devebp and improve private property does not constitute the right to physicalty damage or adversely impaG the property or properly value of neighboring landowners." To remain consistent with this Deka County Master Plan, this application for a Rock Quarry by the Bensons should be denied. Also, the Bensons have not demonstrated compliance with these regulations, according to Section S, page 2 of Delta County Regulation for Specific Developements. Section 8 of this document states: "The burden of demonstrating complicance with these regulations, including the responsibility to submit complete and accurete application materials, rests with the applicants." Benson Brothers has not demonstrated compliance with Delta County Regulations, nor have they submitted complete and accurate materials, in their application. Much information has been omitted, including the numerous houses Gose to the proposed Benson Quarry site (as seen in their mislabeled Coalby Map), and discription of the Benson properly as "remote". To disregard the welfare of Coalby Canyon residents, would be negligable. In addition to this, abundant wikllife lives in Coalby Canyon. On the Benson property, including the Sandstone CI'df area, these animals have been sighted by area residents:' Mountain Lions Bob Cats Bald Eagles (they are known to nest on tiffs) Turkey Vultures (an endangered specles) Elk Mule Deer The Division of Wildlife has been contacted to report a possible violation of the habitats of the wild animals listed above. These wild animals would be displaced and endangered if the proposed Rock Quarry were to be approved. We respectfulty request that the Application by Benson Brothers for a Rock Quarry in Coalby Canyon be denied. Thank you.
