This means that the wells must be <br />operated under acourt-approved plan for augmentation. <br />3. Exhibit G contains a letterfrom Strong Farms, Inc., stating <br />that 5 acre-feet of water is available for the mining pur- <br />poses. The applicant has evidently received no commit- <br />ment for the 10 acre-feet of water to be used annually for <br />re vegetation. A dependable, legal source of irrigation <br />water must be provided prior to Board approval. <br />4. Exhibit E states that "four ponds totaling approximately 95 <br />acres" will be created as part of the reclamation plan. The <br />applicant fails, however, to discuss the effects of the per- <br />petual loss of several hundred acre-feet of water annually <br />to the critically over-appropriated South Platte River system <br />due to evaporation from these ponds. The applicant should <br />provide an augmentation plan that permanently replaces <br />this loss in order to minimize the disturbance to the prevail- <br />ing hydrologic balance and prevent injury to senior water <br />rights . <br />William R.
