NOW TE~REFORE, Pursuant to the authority set forth in ttie Colorado Open Mining Land Reclamation Act, the Land Reclamation Board of the State of Colorado has determined that the following land stabilization and reclamation procedures will be followed in the mining operation of Specification, Inc. ' in NW's, Section 15, Township 4 South, Range 70 West, Sefferson Cointy, Colorado, and Specification, Inc. hereby agrees to faithfully perform the land stabilization and reclamation work required herein. 1. Specification, Inc. will stockpile and retain topsoil wherever possible. 2. If Specification, Inc. plans to discharge into a water ray, then a permit to discharge into same will be obtained from the: Environmental Protection Agency and Specification, Inc. will abide bpi the regulations pertaining thereto or those set by the Colorado Water (duality Control Commission. 3. Specification, Inc, will control erosion on or along haul roads by the use of drainage ditches, culverts or check dams. 4. ^°~••- ~drainwaye-,-sf.drainways constructed to alleviate flood conditions in the area shall be kept free from overburden, stockpiles and topsoil, 5. If siltation occurs in the body of water on the Herite.ge Square Property as a result of drainage from operator's pit operation, V-ditches or check dams shall be installed where needf:d. 6. -aily operation will not begin before 6:00 a.m. nor e:ctend past 10:00 p.m., except for maintenance work on machinery. 7. Blasting will be conducted during daylight hours only and in a manner to alleviate or curtail shock and concussion nuisance by controlling the size of the blast. l• 8. Specification, Inc. will monitor fugitive dust resulting from this operation to keep same in compliance with the dust emission standards set by the Air Pollution Control Commission of the State of Colorado. 9. Trailers and/or buildings used for office, storage, Bind maintenance shall meet local zoning regulation. v s. - 2-
