'3 .SERIES 2003 <br />MIDAS MINING COMPANY, INC., PROPOSED <br />OPHIl2-NEVADA MINING OPERA7TON <br />All Mining and Related Operations shall strictly comply with the following: <br />All conditions and stipulations as proposed and outlined in the State of Colorado <br />Department of Minerals and Geology mining permit and the U.S. Departmern of <br />Interior, Bweau of Land Management, Gunnison Field Office letter ofAugust 2, <br />2002 as attached to this resolution shall be strictly followed during the operation of <br />this mining activity with specific attention to mitigation of potential vehicle traffic <br />conflicts. <br />• If any operations are schedule at night, all lighting must be shielded so that it focuses <br />toward the ground and arty light emissions must nat extend 300 feet past the mine <br />tunnel opening. <br />• Any sale, lease or other change in prescrK ownership, or changes in the currently <br />proposed operation as stipulatedcn the approved mining permit from the State and/or <br />[he Bureau of Land Management requiremerns, will first require prior submission to <br />the Coutrty Planning Commission for review, and after a public hearing, <br />consideration for approval or disapproval by the Board of Coumy Commissioners. <br />• No more than six truckloads per day using no largerthan atop-wheel tandem dump <br />truck shall be allowed. Any anticipated increases from the proposed 100 tons (or six <br />truck loads) per day in transport of ore shall first require application to, and a review <br />and additional permit by, the Coumy, <br />• Other than that ore being stored on-site awaiting transport, ore shall not be scared <br />and/or processed in any manner elsewhere in Hinsdale County without Srst making <br />application to, and review and approval by, the County. Any ore stored on-site must <br />be covered in order to prevent the material from becoming wet or leaching <br />undesirable materials into the ground. <br />• If the $oard of County Commissioners considers the operation of the mine to be <br />beyond the scope of the approved State permit and/or other stipulations outlined <br />above, the County may issue a cease and desist order until all disparities are clarified <br />or additional reviews and approvals are made. <br />
