Box 1908 Rifle, CO 81650 (970)625-2121 August 9, 2001 Mr. Gregg Squire Colorado Division of Minerals and Geology 1313 Sherman Street Room 215 Denver, CO 80203 RECEIVED auc ~ 5 200 Division of Minerals and Geology Re: Application of Roaring Fork Resources inc./ Mamm Creek Gravel Pit/ Application No. M-2000-113 Dear Mr. Squire: As you are aware, due to its close proximity to its municipal boundaries and attendant impacts presented by the same to the City of Rifle ("Rifle"), the specifics of the Mining and Reclamation plans submitted by Roaring Fork Resources, Inc. ("Applicant") within the above referenced Section 112 application have been and are of great interest to the Ciry. The City's initial comments/objections th this regard have previously been communicated to your office pursuant to written correspondence prepared by the City's engineer, Jefferey S. Simonson and the City's attorney, Loyal E. Leavenworth, dated November 1, 2000 and December 12, 2000, respectively. Many of these concerns were also reiterated by City representatives during the Informal Conference conducted by your office in Rifle City Hall on January 4, 2001. In addition to the concerns and concomitant Ciry involvement above described, the Ciry has, in its own regulatory capacity, been actively involved in reviewing Applicant's proposed mining operations and the possible impacts presented therefrom under the City's Watershed District regulations. Following numerous site visits to the proposed mining property by City Staff and individual City Council members and the commissioning by the City of a floodplain study (HEC- RAS) for that portion of the Colorado River likely to be affected by Applicant's proposed mining operations, the City entered into extensive negotiations with the Applicant for the purpose of establishing and defining the nature, type of extent of measures that would need to be undertaken by Applicant to adequately mitigate those the impacts -relevant both to the Section 112 permitting process and other, broader land use and environmental matters -likely to Abe presented by its proposed mining operations. As a result of said negotiations and in conjunction with the permitting process provided under its Watershed District regulations, the City has recently reached an agreement with Applicant. A copy of the Agreement is attached hereto for your reference as Exhibit A. In addition, the City issued the Watershed District Permit (FINDINGS OF FACT, CONCLUSIONS OF LAW AND APPROVAL OF WATERSHED DISTRICT PERMIT NO. 1-Ol) to Applicant on June 20, 2001, a copy of which is attached hereto for your reference as Ezhibit B.
