COLORADO DEPARTMEM OF PUBLlC HEALTH AND ENVIRONMENT, W¢ter Quality Control Di visi¢rt <br />Rationale -Page B, Permit No. CO-0038776 <br />b. stormwater Management Plans (SWMPs): The purpose of a SWMA is to identify possible pollutant sources to stormwater <br />an to set out est mana event practices that, when imylemenied, will reduce or eliminate any possible water quality <br />impacts. A SWMP must ~e maintained for the West Elk Mine in accordance with good engineering practices. (The plan <br />need notbe completed by a registered engineer.) The Division has a guidance document available on preparing a SWMP. <br />The plan identifies potential sources of pollution (including sediment) which may reasonably be expected to affect the <br />quality of stormwater discharges associated with minirsg or remediation operations. In addition, the plan describes <br />practices, which will be used to reduce the pollutants in stormwater discharges from the mining or remediation operation, <br />and to assure compliance with the terms and conditions of this permit. Facilities must implement the provisions ojtheir <br />SWMP as a condition ofthir permit. <br />There are separate sections in this permit addressing SWMP requirements for pollutant sources in active and inactive <br />portions of the West Elk Mine. <br />i. In the event that the permutee wakes to remediate an inactive mine site and terminate permit coverage, <br />prior to remediation activities, the SWMP must be amended to include the following items, and the perminee must <br />notify the Division of the change in status: <br />1) Documentation ojlandownerpermirsion (ifthepermittee is not the owner) <br />2) Photographs <br />3 Description of remedial action to bepetformed <br />Description o BMPs durin remediation activities <br />) Procedures or disposal of anyy water stored within mine waste <br />6) Description ofpermanent BMPs to be used, final site stabilization, and ultimate land use <br />SWMP Develo ment Coordination and Format: Some activities required under the SWMP may already be in place. <br />owever, t e - wi require t e ermihee to coordinate these activities with any necessary new activities to an orderly <br />. manner, so that the result u the reduction or elimination of pollutants reacF.ing state waters from areas not limited by <br />numeric effluent limitations. <br />It is the perminee's responsibility to notify the Colorado Division of Minerals and Geolo~ (CDMG) of any changes at their <br />site resulting from the implementation of the SWMP. This notification allows the DMG to review the SWMP and <br />incorporate any potential revisions, which mi ht be needed into the facility's reclamation permit. Ir is im arrant to verify <br />that the site reclamation permit matches the S~MP. Such information u usually contained in Exhibit G ofP10 reclamation <br />permits. <br />The SWMP may gely upon information developed for other similar pollution control programs such as the SPCC (Sill <br />Prevention Control and Countermeasures) plan, Voluntary Cleanup Plan, or the Mined Land Reclamation Plan. <br />Appropriate portions o these other plans may be incorporated ~in the SWMP by reference, as long as a complete SWMA~ <br />can be reproduced and subminea to the requesting agency within the time frame specified in the request. Those portions of <br />the referenced documents must be included in the submittal. The SWMP must also be readily available So an on-site <br />inspector. <br />c. Com rehensive Facili Ins ections: The permittee shall make a thorough inspection of their stormwater management <br />system, at east twice per yyear in the sprin and fall). These inspections must be documented and summarized in the <br />Annual Report (see Part I1J.2.g ojthe permit <br />d. Annual Re art: The permittee will be required to submit an Annual Report, covering January 1 through December 31 of <br />eat year, on the compliance with the SWMP. The Annual Report shall contain, at a minimum: <br />i. A report on the facility's overall compliance with the SWMP, including a progress report on remediation activities. <br />ii. A summary of all comprehensive stormwater inspections made. <br />iii. Results and intetpretahon of any stormwater monitoring pet formed. <br />the Annual Report will be due to the Division on or before February IS of the following year (see Part ID.2.g of the <br />permit). - <br />All reports required for submittal shall be signed and certified for accuracy by the permittee.
