PARTI <br />Page No. t4 <br />Permit No.: CO-0038776 <br />vi) Consistency with Other Plans <br />SWMPs may reflect requirements for S ill Prevention Control and Countermeasure (SPCC) plans Hader section 311 of the <br />CWA, or Best Management Practices ~BMPs) Programs otherwise required by a C PS percut, and may incorporate any <br />part of such plans into the SWMP by reference. The SWMP ma reflect information contained in approved plans <br />submitted for other similar pollution control programs, including the Voluntary Clean Up Program. (Voluntary Cleanup and <br />Redevelopment Aci, CRS 5-16-303) as long as they contain the elements descnbed above. These plans must have been <br />approved by the implementing agency prior to application for the Stormwater Pemiit. Appropriate portions of these other <br />plans maybe incorporated in the SWMP by reference, as long as a complete SWMP can be reproduced and submitted to the <br />regluesting agency within the time frame specified in the request. Those portions of the referenced documents must be <br />inc uded m the submittal. The SWMP must also be readily available to an on-site inspector. <br />b. General Limitations <br />The following limitations shall apply to all discharges authorized by this permit: <br />i) Stormwater discharges from mining operations or mine-waste remediation projects shall not cause or threaten to cause <br />pollution, contamination or degradation of State waters. <br />ii) Bulk storage structures for petroleum products and other chemicals shall have adequate protection so as to contain all spills <br />and prevent any spilled material from entering State waters. <br />iii} No-chemicals aze to be added fo the discharge unless percussion for the use of a specific chemical is granted by the <br />Division. In granting the use of such chemicals, special conditions and monitoring maybe addressed by sepazate letter. <br />iv) All dischazgers must comply with the lawful re uirements of counties, drainage districts and other state or local agencies <br />regazding any discharges of stormwater to storm drain systems or other water courses under their jurisdiction. <br />c. SWMP Reouirements <br />f) SWMP Submittal/Review/Charges: The Division reserves the right to request and review the plan, and [o regwire additional <br />measures to prevent and control pollution, as needed. Upon revrew of the SWMP, the Division may notify the perrruttee at <br />any time that the plan does not meet one or more of the minimum requirements of this permit. After sucfi notification, the <br />permittee shall make changes to the plan. Unless otherwise provided by the Division, the permtttee shall have 30 days after <br />such notification to both make the necessary changes to the plan and to uriplement them. <br />The permittee shall amend the plan whenever there is a chuge in design, constriction, operation, or maintenance which has <br />a s'¢ntficant effect on the potential for the discbarge of pollutants to the waters of the State, or if the SWMP proves to be <br />ineffective in achieving the general ob]'ectives of controlling pollutants in stormwater dischazges associated with minrng <br />activity. Amendments to the plan shall be s>>**+*+~a*»ed in the Annual Report. <br />d. Prohibition of Non-stormwafer Dischar¢es <br />i) Except as provided in paragraph b, below, all dischazges authorized by the stormwater portion of this permit shall be <br />composed entirely of storinwater. Dischazges of water other than stormwater must be addressed in a separate CDPS permit <br />issued for that dischazge. <br />ii) Dischazges from the following sources that aze co.~ib;,-ied with stora•.water discharges associated with mining activity maybe <br />authorized the stotmwater pportion of this pemut, pprovided that the non-stormwater component of the discharge is identified <br />in the SWMP (see Part I.D.2.c of the permit): fue fighting activities, uncontaminated compressor condensate, irrigation <br />drainage, laws watering, air conditioner condensate, uncontaminated seeps and springs,-and foundation or footing drains <br />where flows aze not contaminated. <br />e. I'aciliri Inspections <br />Qualified personnel identified by the operator shall make a thorough inspection of their stonnwater management syste at least <br />twice per yeaz (in the spring and fall). These inspections must be documented and surmnari~ed in the Annual Report see Part <br />l.E.l of the permit). <br />The inspections must include the following: <br />i) Disturbed areas and aeeas used for material storage that aze exposed to precipitation shall be inspected for evidence of, or <br />the potential for, pollutants entering the drainage system Erosion and sediment control measures identified in the SWMP <br />shall be observed to ensure that they aze operating correctly. <br />ii) Based on the results of the inspecfion, the description of [he potential pollutant sources and the pollufion prevention and <br />control measures that aze identified m the SWMP shall be revised as appropriate as soon as practicable after such <br />inspection. Revised control measures shall be ' lemented a timely manner, but in no case more than 90 calendaz days <br />after the inspection, unless otherwise provided by the Division. <br />iii) The operator shall keep a record of inspections, including the date of the inspection, major observations relating to the <br />implementation of the SWMP, and actions taken in accordance with pazagraph 2), above. This record shall be made <br />avazlable to the Division upon request and summarized in the Annual Report. <br />f SWMP Availabiliri <br />Upon request, the pemvttee shall submit a copy of the SWMP to the Division, the Colorado Division of Minerals and Geology <br />and EPA, and any local agency approving sediment and erosion plans or stormwater management plans, within the time frames <br />specified in the request. <br />Revised G192004 <br />
