It is understood by both parties that the validity of this agreement is <br />contingent upon United Companies receiving local approval to use the land as <br />stated herein, and receiving a mining permit from tl~e Mined Land Reclamation <br />0lvision. <br />Permits that are secured for operations at this site shall be in the name of <br />United Companies of Mesa County, Inc. and shall indicate United as the <br />responsible operator. <br />It is the intent of this agreement to provide United Companies the right of <br />access to the property described for the purpose of extracting, processing <br />and distributing gravels. <br />The right of use shall include the operations of a gravel crusher, a hot <br />mixed asphalt plant and the storage of related equipment. <br />Edward N. Koch retains the right for all minerals that may exist on the <br />property except sand and gravel. <br />United Companies agrees to supply to Edward Koch, Certificates of Insurance <br />for liability and workers compensation insurance. <br />United Companies agrees to assume the responsibility for the payment of <br />personal property taxes that are accrued through the production of gravel at <br />this site. <br />' AGREED TO TFIIS mss.
