1 <br /> <br /> <br />BOARD ORDER <br />Based upon these same Findings of Fact and in accordance with C.R.S. 24-4-105, the Colorado <br />Mined Land Reclamation Board hereby order that the Hatchet Ranch Pit, whose operation, use of <br />materials for building roads in the Hatchet Ranch residential development, and the reclamation of <br />the pit , all of which are described in the petition submitted by Red Creek Ranch, is not mining <br />and a state reclamation permit is not required subject to the following condition: <br />To operate under this Declazatory Order, the above-described site's operation, and use of <br />materials must remain in conformance with the petition, except that no compensation is <br />to be received for any material that is mined.
