Hall-Irwin commits to submitting the necessary slurry wall design, specifications, and quality <br />assurance plan as a technical revision prior to slurry wall installation. Please note, as Allen <br />Sorenson described in his July 21, 2003 e-mail (included in the July 29, 2003 adequacy <br />response letter), groundwater may be exposed as necessary for the construction of the slurry <br />wall in accordance with the approved TSSP for the site. <br />6.4.14 EXHIBIT N -Source of Legal Right to Enter <br />24. The mining permit boundary encompasses all of the property described as: "A parcel of land <br />being all that part of the SE %< and part of the E % SW'/, of Section 12, Township 5 North, <br />Range 65 West of the 6~' P.M., County of Weld, State of Colorado." And a portion of the <br />property described as: "Lot B of Corrected Lot B of 2^d Amended Recorded Exemption No. <br />0961-12-4-RE1053, recorded July 11, 2001 as Reception No. 2864757, being a part of the SE <br />'/, of Section 12, Township 5 North, Range 65 West of the 6~' P.M., County of Weld, State of <br />Colorado." <br />Both parcels are owned by Water Resources, LLC and the legal right to enter included in the <br />application gives Hall-Irwin Corporation the right to enter into both parcels. <br />25. The applicant's legal right of entry is based on the exact location of easement boundaries for <br />structures. <br />6.4.19 EXHIBIT S -Permanent Man-Made Structures <br />26. The Stability Analysis originally submitted is a conservative analysis based on the use of <br />conservative strength parameters in the modeled profile and is consistent with analysis <br />requests made by DMG personnel on past submittals. Due to the conservative strength <br />parameters utilized in the analysis, the factor of safety generated should be acceptable and <br />provide reasonable assurances that nearby structures will not be harmed by site mining <br />activities. <br />King Surveyors provided the base map for this project. The survey map designated <br />"approximate" on the underground utility locations. The pipes are shown within the legal <br />easements, or as surveyed by pipe location markers provided by the utility companies. The <br />language on the Mining Plan states that the setbacks are based on the stability analysis <br />requirements, and that all underground utilities shall be located prior to mining.
