Simon's letter <br />regarding the subject application. Apparently, Mr. Simon's <br />objections stem from a desire to be able to sell his <br />property for development of a residential area. Mr. Simon <br />may not be aware of the following facts: <br />1. This is not a new mine; it has been in operation to one <br />degree or another for 34 years. <br />2. Lengthy and comprehensive laws exist with regard to noise, <br />smoke, dust and reclamation. Compliance with the laws <br />is incumbent on the operator. <br />3. Sections 34-1-301 through 305 of Colorado Revised Statutes, <br />1973, Revised, stipulate that no zoning change to accom- <br />modate residential development can be made until the <br />underlying commercial mineral deposit has been extracted. <br />ROBCO's legal right to mine the natural resources before they <br />are covered up forever by residential development must be <br />upheld.
