MEMORANDUM OF UNDERSTANDING <br />BETWEEN THE <br />DIV. OF MINERALS & GEOLOGY, MINERALS PROGRAM <br />AND THE <br />DIV. OF WATER RESOURCES, OFFICE OF THE STATE ENGINEER <br />PURPOSE <br />The purpose of this Memorandum of Understanding (MOU) is to define the respective <br />responsibilities of the Division of Minerals and Geology, and the Division of Water <br />Resources, Office of the State Engineer, regarding mineral mining activities as they relate <br />to water righu issues. In addition, it is the intent of this MOU to: <br />1. Ensure the coordination of agency actions in such matters. <br />2. Ensure that appropriate agency actions are taken at mining operations to protect <br />the water resources of the state. <br />3. Foster enhanced communications and working relationships between the two <br />Divisions. <br />4. Coordinate enforcement actions so as to m;n;*n;~e dual enforcement to the <br />extent possible, while maintaining the integrity of the programs implemented by <br />each Division. <br />UNDERSTANDING BETWEEN THE DIVISIONS <br />This MOU is entered into by the Division of Minerals and Geology (DMG), and the <br />Division of Water Resources, Office of the State Engineer (SEO), (the patties) and may <br />be modified by written concurrence of both parties. <br />Nothing in this MOU will be construed to preempt or alter the statutory or regulatory <br />responsibilities and authorities of either parry. <br />N~ <br />This MOU is entered this`' Day ofS~-~.- , ~ <br />Michael B. g, r Ha] Simpson, State Engineer <br />• <br />
