The operator has the <br />following options; <br />a) Provide the Division with the signed and notarized agreemenUwaivers by March 27, 2000, <br />b) Extend the Division's decision due date to allow the operator additional time to submit the <br />signed and notarized agreements/waivers, or <br />c) Commit in writing as a binding part of Ft. Lupton Sand and Gravel Mining Application that <br />no mining, reclamation or slurry wall construction will take place within 200 feet of any <br />permanent man-made structure (not owned by the applicant) until the above noted signed and <br />notarized agreements/waivers are submitted and approved by the Division. Approval from the <br />Division wil{ be in the form of a written letter that the agreements have been received and are <br />in compliance with the requirements of Rule 6.4.19. <br />Please be advised that the Ft. Lupton Sand and Gravel application may be deemed inadequate, <br />and the application may be denied on March 27, 2000 unless the above mentioned adequacy <br />review items are addressed to the satisfaction of the Division. If you feel more time is needed to <br />complete your reply, the Division can grant an extension to the decision date. This will be done <br />upon receipt of a written waiver of your right to a decision by March 27, 2000 and request for <br />additional time. This must be received no later than the deadline date.
