DMG may then issue conditional approval. <br />with the concurrence of the SEO, that includes provisions to protect potentially <br />impacted water resources. <br />7. SEO will assist DMG staff in locating filings on springs, seeps, wells, etc. <br />during the DMG permit review or enforcement process. <br />Inspections and Monitoring: <br />The parties agree to coordinate inspections and monitoring of mine sites in the followir.; <br />manner: <br />1. Doting [he course of conducting its normal mine site inspection obligations, <br />DMG will ensure that the operator is in compliance with those aspects of the <br />approved reclamation plan that is designed to prevent injury to water rights. Such <br />practices may include, but not be limited to pumping, clay liner installation, slurry <br />wall installation, backfilling, approval by the Water Court of a plan of <br />augmentation, or approval by the State Engipeer of a plan for substitute supply. <br />Where DMG fords ground water exposed, or the operation not being pumped as <br />specified in an approved MLRB permit, DMG will notify the SEO by sending a <br />copy of the inspection report to a designated person by the SEO. <br />2. Where an operator is approved to conduct a dry mining operation that does not <br />expose ground water, and the approved application includes ground water <br />elevation monitoring wells, DMG will ensure [hat the operator supplies the ground <br />water elevation data to DMG as specified in the approved application. DMG will <br />make such information available to the SEO when requested within a reasonable <br />period of time. <br />Enforcement• <br />The parties agree to coordinate and pursue enforcement actions in the following manner: <br />1. SEO is responsible for any enforcement action designed to reduce or eliminate <br />injury to water rights. <br />2. DMG is responsible for any enforcement action designed to ensure compliance <br />with an MLRB reclamation permit. <br />3. Where there is a potential for overlap, the parties will jointly determine the <br /> <br />
