Uept. e'. hfat:;ral Reso~:rces <br />In yesterday's letter I neglected one thing and made a mistake on <br />another. I neglected to officially request a pre-hearing conference <br />and am so doing now. <br />The mistake was the same mistake many others have made, i.e., reading <br />the Rules and Regulations to say the operator will publish notice <br />"four times, once a week for four consecutive weeks" which is what the <br />rule states, when the literal meaning is the operator will publish <br />notice "four times, once a week for three consecutive weeks". The <br />result is that the published latest date for filing objections (20 <br />days following the last publication) is one week later than it should <br />be. (Specifically, I began publication on October 13, and four pub- <br />lications, one week apart for four weeks would, at first glance, put <br />us at November 10 as the final publication date. In actuality November <br />3 is the final date of publication.) <br />A conversation with Marsha Hughes indicated the mistake would not cause <br />any technical legal problem subject to contest by the A.G. or any third <br />party and that the only practical outcome would be that the Board could <br />not act on the application until after the date published as the latest <br />date for filing objections, i.e., November 30. <br />I am sorry for the confusion, however the fact that even I am not able <br />to do everything exactly right might provide an indication of the pro- <br />blems encountered by the small miner who is completely unaware of the <br />many intricacies involved in submitting an application. <br />Sincerely, p <br />Larry F.
