The size of the working space around the <br />wellheads will have to be finalized by Clay Munger, Merit's Colorado operations <br />manager. He can be reached at 303-857-6766. <br />The reasons there can be no structures or improvements in the wellhead working <br />space, within the flowline easements and within 200 feet of the production facilities are <br />(i) the safety of people who may come in contact with the Merit operations and (ii) the <br />potential for substantial damage to any stnactures and improvements during normal oil <br />and gas operations and workover operations utilizing a workover rig. <br />Again, Merit does not object to Hall Irwin's plans to mine the property, provided <br />the rights and interests of Merit and the owners of the minerals in and under the lands <br />are addressed and adequately protected from the outset by addressing the operational <br />concerns as part of the mining permitting process. <br />Thank you for the opportunity to comment on the proposed annexation and if you <br />have any questions, please contact Clay Munger or me. <br />Very truly yours, <br />K ITH M'".
