<br />W5. Operator will construct an earth dam in the final cut of this <br />operation, if necessary to impound water, if such impoundment <br />will not interfere with mining operations or damage adjoining <br />property, <br />W6. Operator will take any necessary measures to prevent undesirable <br />seepage from water impoundment sites and will provide adequate <br />spillways or other measures necessary to control overflow. <br />W7. Natural drainways or drainways constructed to alleviate flood <br />conditions in the area shall be kept free from overburden, stock- <br />piles, and topsoil. <br />W8. Operator will obtain permission from the local county authorities <br />before using water from any waterway, to prevent usurping any <br />adjudicated water rights. <br />Zonin <br />Z1. Trailers and/or buildings used for office, storage, and maintenance <br />shall meet local zoning regulations. <br />Z2. Special use or other Eorms of permits shall be obtained from the <br />county agency authorized to grant such permits. <br />Z3. Nothing in this agreement shall subrogate the operator's responsi- <br />bility for compliance with local county zoning requirements. <br />-6- <br />
