6.4.16 EXHIBIT P - Municiaalities Within Two Miles <br />This section is adequate as submitted. <br />6.4.17 EXHIBIT O -Proof of Mailine of Notices to County Commissioners and Soil <br />Conservation District <br />This section is adequate as submitted. <br />6.4.18 EXHIBIT R -Proof of Filine with County Clerk and Recorder <br />This section is adequate as submitted. <br />6.4.19 EXHIBIT S -Permanent Man-Made Structures <br />The application includes a statement that mining will not occur within 200 feet of any of <br />the identified structures included with the permit application. The division requires <br />notarized damage compensation agreements, engineering evaluations, or utility <br />statements per Rule 6.4.19. In lieu of such agreements the maps will need to be revised <br />to cleazly show the affected azea boundaries being 200 feet away from any structure <br />where there is not an agreement. In addition, there appeaz to be some additional <br />structures that aze not included in table 6.4.19.1 including the dwelling and associated <br />outbuildings in the southeast corner of the property, the county roads on both the south <br />and east sides of the permit area, livestock fences sun•ounding the property, and buildings <br />and roads on the north side of the property. Please review the site and include al] <br />structures as defined under Rule 1.1(48) and their associated agreements. <br />6.5 GEOTECHNICAL STABILITY EXHIBIT <br />There is no comment at this time, however, depending on the outcome of the various <br />agreements associated with the structures in the previous exhibit, additional information <br />may be necessary. <br />This concludes the Division's preliminary adequacy review of this application. Please <br />remember that the decision date for this application is November 18, 2005. As <br />previously mentioned if you aze unable to provide satisfactory responses to any <br />inadequacies prior to this date, it will be your responsibility to request an extension of <br />time to allow for continued review of this application. If there aze still unresolved <br />issues when the decision date arrives and no extension has been requested, the application <br />will be denied. <br />
