<br />The underground portions of the quarry receive water from faults in the marble, primarily <br />in early summer. This water is generally retained within the settling sumps in the quarry. But <br />during high runoff periods, some water discharge will be pumped from the sumps. The quality <br />of the water in the sumps has been monitored periodically by the Colorado Department of <br />Health. Records indicate no water quality problems and none are expected in the future. CYMC <br />operated the quarry under Permit No. CO-G-500184 issued by the Colorado Department of <br />Health. Sierra has received a new Process Water and Stonnwater permit from that agency <br />(Permit No. COG-500356). The maximum flow from the quarry is estimated at 33 gpm (0.13 <br />cfs) during the high flow season, so there should be no noticeable impact on Yule Creek from <br />such dischazge. <br />The sediment control structure constructed by CYMC at the tee lower end of the waste <br />pile was observed in June of 1999 to be ineffective in preventing sediment from the waste piles <br />from reaching Yule Creek. Sierra determined that quarry dischazge water should not be pumped <br />into the waste pile as had been CYMC's practice. Siena sought, and received, an amendment to <br />its discharge permit from the Colorado Department of Health so that Sierra can discharge the <br />quarry water directly into Yule Creek. <br />Based on a site visit in eazly June of 1999, CDMG's staffl~identified problems with, <br />and/or possible violations of CYMC's permit with the CDMG. Even though Sierra has included <br />azeas of potential violations within the affected area for this permit, Sierra will not perform any <br />activity that may impact the areas of potential damage until such damage is corrected. <br />jdi Wildlife: Based on recent contact with the Colorado Division of Wildlife, there are <br />no critical or important wildlife habitats or wildlife species that will be impacted by the proposed <br />operation. A letter from the Division to that effect is attached. <br />13 <br />
