March 31, 2006 <br />Ms. Erica Crosby RECEIVED <br />Division of Minerals and Geology <br />1313 Sherman Street, Room 215 APR 0 4 2006 <br />Denver, Colorado 80203 Oivisian ~f Minerals and Geology <br />RE: Hall-Irwin Corporation, Application No. M-2006.003 <br />Parker/Dersham Sand and Gravel Resource; March 13, 2006 Adequacy Review <br />Dear Ms. Crosby: <br />Following is our response to your Adequacy Review dated Marcy 13, 2006. <br />1. As required by Rule 1.6.2 (1)(g), please submit the proof of publication of the public notice <br />circulated in the local newspaper, all owners of record of surface and mineral lands, <br />easement holders, and owners of record of surface lands that are within 200 feet of the <br />boundary of the affected land. Proof of notice may be return receipts of a Certified Mailing <br />or by proof of personal service. <br />Enclosed please find the proof of publication of the public notice circulated in the local newspaper, <br />and the receipts for the Certified Mailing to surface owners of record, easement holders, and <br />surface owners of record within 200 feet of the affected land boundary. <br />2. Rule 6.2.1(2) requires that maps be signed by a registered land surveyor, professional <br />engineer, or other qualified person. The maps submitted to the Division were not signed. <br />Please resubmit a signed copy of the maps. <br />We have enclosed signed maps. <br />3. The Division received comments from the NRCS, the Office of the State Engineer, the Army <br />Corps of Engineers and Kerr-McGee Rocky Mountain Corporation regarding the proposed <br />application. The letters are attached. Please address the comments noted in the letters, <br />and make any changes the application as necessary. <br />Referral Comments <br />NRCS <br />a. The final reservoir slopes will be no steeper than 3:1. Topsoil stockpiled for reclamation will be <br />segregated from other spoil. Because the phases are relatively small and there is limited room <br />for stockpiles, they will be graded with final slopes no steeper than 2.5:1 to allow for <br />maintenance. Stockpiles that are undisturbed for more than 45 days will be seeded as <br />weather permits to protect them. Per NRCS' recommendation, Hall-Irwin will use Luna <br />pubescent wheatgrass and/or Amur intermediate wheatgrass at a rate of 15 total pounds PLS <br />per acre to seed the stockpiles. We already have many of the MRCS' recommendations <br />incorporated on the Reclamation Plan (refer to the notes). We have revised the reclamation <br />seed mix per NRCS' request. <br />
