<br />mining operation after termination of operations under the Lease, such plan expressly to become
<br />elTective upon the cessation of mining operations by the Lessee.
<br />Ooerations. The Company's operations on the Property shall be conducted
<br />in a workmanlike manner in accordance with good and accepted mining practices and in compliance
<br />with all applicable federal, state and local laws, rules and regulations including without limitation
<br />environmental laws, laws concerning the handling and storage of petroleum products and laws
<br />relating to hazardous substances. The Company shall have the right to install, construct, operate,
<br />maintain, dismantle, and remove all of its plants, machinery, equipment, improvements, and other
<br />facilities including, but not limited to, roads, conveyors, pipe lines, power lines, telephone lines,
<br />water courses, wells, dams, ponds, and stockpile areas on the Property. The Company shall have
<br />the right, during the Term of this Lease, and without any payment to Lessor (except for the royalty
<br />provisions of Paragraph 2), to strip and remove overburden on and from the Property, and otherwise
<br />to use and occupy the Property even in conjunction with other properties all as reasonably required
<br />in connection with mining, quarrying, extracting, processing, storage, sale and removal of stone,
<br />sand and gravel, in, on, under, or from the Property. Lessor hereby authorizes the Company on its
<br />behalf and will cooperate with the Company to, at the Company's expense, apply for and obtain
<br />zoning and other governmental classifications, permits approvals, licenses and rights (hereinafter
<br />"authority") reasonably required in connection with the lawful conduct of the Company's business
<br />and operations related to the Property. It shall be the Company's obligation to make such
<br />commitments and to provide such bond or other security for restoration, reclamation or rehabilitation
<br />of the Property as may be required or advisable in order to obtain the desired authority. Lessor shall
<br />consent to and reasonably cooperate with the Company in connection with the Company's efforts
<br />to obtain any required authority hereunder, The Company agrees that, unless otherwise required by
<br />the substitute supply plan described in paragraph 5, any discharge water as a result o(the Company's
<br />mining operations will be on or across the Company's adjoining property. Company further agrees
<br />not to backfill any ponds created by the Company's mining operation without the agreement of
<br />Lessor,
