- :~.

The mining map shows the north pit azea as a 6-acre block. The cross-section of the pit clearly shows the
co~guration of the excavation. Is this cross-section a depiction of the slopes during mining, or only during
reclamation? What will be the slope gradient you will maintain in the pit during the mining phase? This
information is needed to calculate the bond.
The northern pit area appears to be within 200 feet of the outer boundary of your property. Please provide to this
office the name of [he adjoining landowner(s), and provide proof of having sent them a notice, as required under
Rule 1.6.2(l)(e). This is listed as item 8 on page 3 of the instructions attached to the application form.
What is to be the setback distance from the edge of the upper pit to the permit area boundary? Please be reminded
that all activity must be carried out within the boundary, including any stockpiling and/or equipment maneuvering
during mining or reclamation. Please clarify.
The map details dealing with reclamation do not clearly show the areas to be revegetated vs those which will not be
revegetated. In particular this involves the margins of the recharge pit vs the water surface, plus any roads in or
near the stockpile area. Will the exterior slopes and/or the interior slopes of the pit's perimeter berm have a stated
maximum slope, have a topsoil replacement requirement or be revegetated? Please comment.
Most of the description of the phased mining and concurrent reclamation is clearly described already. I am asking
for as much additional clarification as needed, so that I may better estimate the amount of the bond. I will begin
calculating my estimate, and any detail you can provide in the above-requested responses, may help influence the
total figure. For any needed changes on the maps, you may resubmit corrected large-sized maps or simply show the
corrections on pertinent portions of the large maps.
Also, since this letter and any response from you are considered application materials, you must place on file these
additional materials with the county clerk and recorder. Please obtain a receipt for this additional filing, and submit
it to this office before the decision date.
Please remember that the decision date is still 5/10199. I must receive your responses before then, with enough time
for me to review them, and if needed, to contact you for additional information. Please be reminded that this office
must receive all required items before the decision date, or your application may be denied.
You may far your responses to me, in the interest of timeliness, but please also mail a hard copy. For all responses
or questions, you may reach me at the Division's Durango field office: 484 Turner Dr., Bldg. F-101, Durango CO
81301; tel 970/247-5193 or fax 970/247-5104.
I look forward to your response.
Sincerely,
~~~~
Bob Oswald
Environmental Protection Specialist
