Randolph Division Director <br />Enid OK 73701-4006 <br />Re: Colorado Gravel Products Inc., File M-1999-I 17, New Application for 110 Permit, Written <br />Responses to Operator's Notices. <br />Dear Mr. Baker, <br />Thank you for the time and expense that went into the written responses you have provided regarding the <br />above-named application. These were received by the Division on 2/15/00 and 2/24/00. I will combine <br />my comments about all pertinent and substantive items from your two letters in this one letter. <br />The applicant initially mailed and published notices which incorrectly stated the post-mining land use as <br />"RL," which you so cleazly pointed out could have been misinterpreted in many ways. For your <br />information, I will clarify that RL was an abbreviation for "rangeland." By the way, yours was not the <br />only communication we received which asked what RL meant. <br />The applicant proposes to leave an unmined buffer strip around the perimeter ofthe site, mine no deeper <br />than 25 feet, and slope the sidewalls at 3:1 gradients, all this with an eye toward providing stability of the <br />site. If this is actually performed as proposed, you probably have little to Fear about your property falling <br />into the gravel pit. The site will be periodically inspected as part of our monitoring program, partly to <br />ensure such offsite damage does not occur. <br />Your request to be notified six weeks prior to the conclusion of mining will have to be arranged between <br />you and the operator, since we only require that the operator notify the surface owner of the affected land <br />and the county commissioners, not the adjoining landowners. I am sorry that I will not be able to honor <br />that request. <br />Apart from the various questions and points you make in your letters, I do not see any stated objections to <br />this application. We consider all adverse public comment of a permit application quite seriously. <br />However, please be aware that this agency does not require written responses from persons who were <br />notified during the application period for a new permitted gravel pit. Though you are free to provide such <br />responses, and this office duly responds to such, please do not feel that there is a burden being imposed on <br />you or others to provide written responses. <br />
