Cottony <br />Division Director <br /> ' Natural Resource Trustee <br /> <br />Re: Russell Ranch Pit, IIOc Application No. M-2006-008, Preliminary Adequacy Review. <br />Dear Mr. Rogers: <br />The Division of Minerals and Geology staff has begun the review process for the above referenced 110c <br />application. The Decision date by Rule is 30 days after the application is considered filed. Denver staff <br />incorrectly noted the Decision Date as March 8`n. The actual Decision Date is base off the February 15`n <br />completeness date and will be March 17`n. Please forgive the mistake. A Preliminary Adequacy Review <br />(PAR) has been completed. Please correct or clarify the following: <br />1) The general plan notes an upgrading of the access road to the site. Please give as much detail as <br />to current condition of the road, dimensions, etc., and proposed upgrades. If more than minor <br />grading and road surface improvements are proposed, the area that encompasses the access road <br />may need to be included in the permit boundaries regardless ofpost mine land use plans. This <br />information is critical as the proposed permit area is already at 9.9 acres and any increase would <br />require a 112c permit. Please refer to Rule 633 (g). <br />2) Please note for the permit file whether or not explosives will be used on site. <br />3) Generat Reclamation recommendations and policy call for 3:1 slopes. Please commit to <br />reclaimed slopes of 3:1 or details that warrant consideration of a 2:1 slope variance. <br />4) Please clarify whether excavation will result in a highwall or will 2:1 or better slopes be <br />maintained at all times. <br />5) Please clarify what materials will be used for the sight berms around excavation areas. Topsoil <br />and overburden must be protected from loss due to erosion or mixing with mineable materials. <br />6) Maps indicate that topsoil will be stored along the northeast boundary. Please clarify what <br />measures will be taken to protect the stockpile from erosion and other loss. Staff recommends <br />seeding with the approved seed mix to establish a ground cover on the stockpiles and create a <br />viable seed bank for future reclamation. <br />7) There is a discrepancy between the amount oftopsoil /overburden on site (1 to 1.5 feet) and that <br />the amount proposed for reclamation (6 inches). Reclamation should include all available <br />material from the original site unless large amounts of overburden are encountered. 1 to 1.5 feet <br />of materials is not considered a large amount. <br />8) Crushing and materials processing are part of the mine operations, yet it is stated that no water <br />will be used.
