COMPLIANCE INFORMATION <br />Introduction <br />Pursuant to Rule 2, Section 3.513) of the Regulations of the Colorado Mined Land Reclamation <br />Board for Coal Mining, the attached is a listing of each violation notice received by Seneca Coal <br />Company for the period September 1, 1997 to October 1, 2001 for any violation of a provision <br />of the Act, or of any law, rule or regulation of the United States, or of any State law, rule or <br />regulation enacted pursuant to Federal law, rule of regulation pertaining to air or water <br />environmental protection incurred in connection with any surface coal mining operation. A list <br />of all unabated cessation orders and unabated air and water quality violation notices received <br />prior to October 23, 2001 by any surface coal mining and reclamation operations owned or <br />controlled by either Seneca Coal Company or by any person who owns or controls Seneca Coal <br />Company is also included. <br />For each violation notice or cessation order reported, the list includes the following information: <br />1. Any identifying numbers for the operation, including the Federal or State permit number <br />and MSHA number, the dates of issuance of the violation notice and MSHA number, the <br />name of the person to whom the violation notice was issued, and the name of the issuing <br />regulatory authority, department or agency; <br />2. A brief description of the particular violation alleged in the notice; <br />3. The date, location and type of any administrative or judicial proceeding initiated concerning <br />the violation, including, but not limited to, proceedings initiated by the applicant to obtain <br />administrative or judicial review of the violations; <br />4. The current status of the proceedings and of the violation notice; <br />5. The actions, if any, taken by the applicant to abate the violation; and <br />6. The final resolution of any notice of violation <br />It should be noted that the attached represents a complete listing of the above-described <br />violation notices or cessation orders and their status as reflected by the file of the Office of the <br />General Counsel of Peabody Holding Company, Inc., 701 N. Market Street, Suite 700, St. Louis, <br />Missouri 63101-1826, as of October 23, 2001. <br />Seneca Coal Company reserves the right to supplement this listing to reflect any information <br />received by the Office of the General Counsel after said date. <br />Suspended or Revoked Permits <br />Seneca Coal Company and associated companies in the Organizational Family Tree have not had <br />a State or Federal mining permit suspended or revoked over the past five years. <br />PR03 Revised 04/02 <br />
