Box 471 `~ ^' 0 71993 <br />~~Boulder, CO 80302 <br />LAND JSE DEPT. <br />Dear Mr. Helmick: <br />This letter is to confirm that I have scheduled a site visit at Dowe Flats with the U.S. <br />Army Corps of Engineers' (COE) and EPA's wetlands representatives on Thursday, 23 <br />September 1993 at 0930 hour. The purpose of the site visit is to locate wetlands that <br />were omitted by Southwestern Portland Cement Company's permit application for the <br />mining and quarry operation as explained in my letter to you dated 14 August. Mr. Terry <br />McKee at COE confirmed that he only looked at wetland azeas that were pointed out by <br />Southwestem's consultant. <br />You should be made aware that Southwestern is receiving "piece-meal" wetland dredge <br />and fill permits for the quarry project. 1 was informed by Mr. McKee that Southwestern <br />received a Nationwide 26 wetlands fill permit on 9 August (Permit No. 1993-80-521) to <br />build a road across the St. Vrain River and wetlands in the floodplains to allow haul trucks <br />to directly enter Boulder County Road 47 by crossing Highway 66 during the quarry <br />operation. Nationwide 26 permits are for minimal impact activities and give an exemption <br />from most wetlands protection requirements, as well as allowing up to one acre of <br />wetlands to be filled without public comments and mitigation. Nationwide permits are not <br />intended as a mechanism to avoid Section 404 requirements; you may want to discuss this <br />issue with Mr. McKee. Requesting multiple exemption permits, each for under one acre <br />of wetland fill, for the same project is not allowed by the COE since the cumulative impact <br />[o wetlands from the quarry project will exceed one acre. Mr. McKee did not realize that <br />the wetlands fill permit issued to Southwestern for the river crossing was part of the <br />overall quarry project. <br />I have enclosed a copy of my CV for your records in case Southwestern questions my <br />qualifications on wetland regulations.
