9. The Applicant is committed to disturbing no more than ten acres of land at <br />any one time, including five acres of area subject to active reclamation and <br />five acres subject to active mining. Therefore, once the Applicant commences <br />mining, it must reclaim any surface that is necessary to ensure that its <br />disturbance is no larger than ten acres. <br />10. This commitment satisfies the requirement in Rule 3.1.5(4) that reclamation <br />be completed as soon as feasible after mining. <br />Water Well <br />11. The Objector is concerned about adraw-down on the aquifer and a possible <br />adverse affect on its well which is located on property adjacent to the <br />proposed mine site. The Objector wants its existing water right protected and <br />wants disturbances to the quantity of the groundwater system minimized. <br />12. The Applicant is obligated to minimize disturbances to the prevailing <br />hydrologic balance of the affected land and surrounding area, as well as <br />disturbances to the quantity and quality of surface and groundwater. The <br />Applicant must do so by complying with Colorado water laws protecting <br />existing water rights and with Colorado water quality laws under Construction <br />Materials Rules 3.1.6(1). <br />13. The Applicant has identified the sources of water and estimated the amount <br />necessary for use in its proposed mining operation, in compliance with <br />Construction Materials Rule 6.4.7(4). The Applicant's plan states that it will <br />haul water in a water truck for use in the mining operation. It will also use a <br />water well as necessary to supplement its water demands for a batch concrete <br />
