Hernandez, Reclamation Specialist 1~~~ <br />RE: File No. M-90-98 <br />Adequacy Items <br />The following items must be addressed by the applicant in order to satisfy the <br />applicable requirements of C.R.S. 34-32-101 et seq. and the Mineral Rules and <br />Regulations of the Mined Land Reclamation Board <br />1. Section 34-32-115(4)(d) states in part: <br />"The Board shall not deny a permit, except for one or more of the <br />following reasons: <br />"The mining operation will adversely affect the stability of any <br />significant, valuable, and permanent man-made structures located <br />within two hundred feet of the affected land, except where there is <br />an agreement between the operator and the persons having an <br />interest in the structure that damage to the structure is <br />compensated for by the operator." <br />Please provide copies of damage compensation agreements between Asphalt <br />Paving Company and the owners of the following structures: <br />a. The Lupton Bottoms Ditch and its branches; <br />b. All utility poles; <br />c. The gas well ana its support facilities; <br />d. The two county road bridges; <br />e. The existing house. <br />Should you not be able to obtain these agreements by October 15, 1990, <br />you will have to establish a 200-foot setback of mining activity from <br />those structures until such time as the agreements are reached and the <br />Division notified. As an alternative to the agreements and the <br />20U-foot setback, you may demonstrate that the proposed operations will <br />not adversely affect the stability of these structures. <br />2. Please describe in more detail the dikes along the South Platte River <br />that exist within the proposed permit boundary and any that exist 200 <br />feet north and south of the permit boundaries. Include in your <br />discussion the location of these dikes, their ownership, purpose, and <br />design. Please locate them on Exhibits C and F. <br />
