I have <br />previously submitted an "Authorization to Represent a Party" form. The purpose of this <br />letter is to protest the 112 Construction Materials Reclamation Permit Application filed by <br />Owens Brothers Concrete Co. in May 2001. It is my understanding that upon receipt of <br />this letter, the Office of Mined Land Reclamation will set the application for a hearing <br />before the Mined Land Reclamation Board, and schedule an Informal Conference, if these <br />actions have not already been taken in response to other submitted comments. See Rule <br />1.7.4(2), Mineral Rules and Regulations for the Colorado Mined Land Reclamation Board <br />forthe Extraction of Construction Materials. It is also my understanding that Mayer Family <br />Farms, LLC has attained full party status, and that, as its representative, Iwill receive all <br />notices generated with regard to this permit application. Please advise me if otherwise. <br />Mayer Family Farms is concerned that the proposed dewatering activity will negatively <br />impact the prevailing hydrology in the area, thereby injuring Mayerwater rights. See §34- <br />32.5-116(4)(h), C.R.S. Mayer Family Farms owns a 160 acre property immediately to the <br />south of the proposed mining site, a 160 acre tract at the intersection of County Road 19 <br />and Highway 66, and another tract approximately 1 mile east of the proposed mining site. <br />These properties are irrigated by six large scale irrigation wells, each of which could be <br />impacted by the applicant's dewatering activities. <br />F:~PAJVvlayerVlotesW10711 DMG.wpd <br />
