On June II, 2001, the Division. of Minerals and Geology approved your ll2c mining permit application. The
condition to the approval is noted below;
No mining activities including excavation, road building, salvage and/or stockpiling of topsoil, salvage and/or
stockpiling of overburden, or plant site development may occur within [he 100 year- tloodplain or within 400 feet
of the top bank of St Vrain Creek, whichever if farther, until the applicant has provided an approvable Flood
ControVMitigation Plan for the Fredstrom Resource.
The amount of financial warranty set by the Division for this operation is $260,500.00. You must submit a
fmancial warranty in this amount and a performance warranty in order for us to issue a permit, in the event you
have requested a financial warranty form, we have enclosed it in this letter. If you have not, please select a type of
financial wartanty from Rule 4.3. Then contact us so that we can provide you with the approvable warranty forth.
We have enclosed a pertormance warranty form with this letter for your use.
PLEASE NOTE THAT MIMNG OPERATIONS MAY NOT COMMENCE UNTII. A PERMTT HAS
BEEN ISSUED BY THE DPYLSION AFTER RECEIPT OF YOUR FINANCIAL WARRANTY AND
PERFORMANCE WARRANTY. A PERMIT WII.L NOT BE ISSUED UNTIL WE VERIFY THE
ADEQUACY OF BOTH YOUR FINANCIAL WARRANTY AND PERFORMANCE WARRANTY.
