The Pemvttee, Phillips County, desires to conduct a mining operation lmown as Haynes <br />Hereford Ranch Pit, for the purpose of erdracting sand and gravel. Unless this permit is modified or a separate <br />penmit is issued to cover the mining andlor recovery of other minerals or ex~tradive products, the Pemrittee will <br />not mina or recover any other commodities at this site. <br />B, On May 5, 2004 the Minted Land Reclamation Board (the "Board") approved the Pemrittee's <br />application far this permit and directed that this permit be issued upon the filing with the Division of Minerals and <br />Geology (the "Division") of performance warranty approved by the I3ivision. Said warranty has been filed with <br />the Division. <br />C. If the Pennittee desires to extract materials other than those listed in (A), a separate permit or a <br />pemtit modification may be required. <br />D. On May 5, 2004 the Board made the following 5ndingc: <br />1. The application for this permit complies with the requirements of the Colorado Mined <br />Land Reclamation Act for the Extraction of Constnrdion Materials, C.RS. 34-32.5-101 et seQ., as amended, and <br />with all applicable local, state and federal laws; <br />2. The operation will nar adversely affect the stability of any significant, valuable, and <br />pemuvrent man-n><~rde struchrre located within two hundred feet of the Affected Larrd, eaccept where there is an <br />agreement between the Operator and the persons having an iruerest in the stnrchue that damage to the sWcture is <br />tq be compensated for by the Perrnittee if such an agreement cannot be reached, an engnreering analysis <br />establishes no damage will darrrage wilt occur to the structure to the satis6ction of the Division; and; <br />Office of Office of Colorado <br />Mined Land Reclamation Active and Inactive Mines Geological Survey <br />
