• i <br /> <br />Page 31 <br />Construction Materials Rule l <br />(3) Applications for amendment shall be reviewed by the Board or <br />Office in the same manner as applications for new Permits. <br />(4) All aspects of the mining operation and Reclamation P]an that <br />aze subject to the amendment will be subject to these Rules, as amended, in <br />effect at the time the Pemtit is amended. <br />ttolsl 1.11 CONVERSIONS <br />1.11.1 Purposes and Types <br />(1) A conversion is an application to change an existing permit to <br />another type of permit such as changing a Limited Impact 110 to a Regulaz <br />Operation 112. <br />(2) Unless such mining is incidental to the permitted activity, any <br />Operator who intends to mine any commodity other than a "construction <br />material" commodity, as defined in Section 34-32.5-103(3), C.R.S., shall apply <br />for a new permit under the provisions of Section 34-32-101, et seg, C.R.S. <br />1984, as amended. Upon issuance of the new permit, the existing permit under <br />Section 34-32.5-101, et seg, C.R.S. 1984, as amended, shall be terminated. <br />Such determinations may be made through declaratory order by the Boazd. <br />1.11.2 Application Process <br />(1) An Operator cannot convert a convertible Permit unless the <br />Operator has held the permit for two consecutive yeazs. <br />(2) All fee, warranty and processing requirements shall apply as <br />though the Conversion application were a new permit application. A fee, as <br />specified in Section 34-32.5-125(I)(a), C.R.S., as amended, shall be submitted <br />at the time of application submittal. <br />(3) Contents of application: <br />(a) except as otherwise indicated in this Subsection 1.11.2, <br />the Operator shall provide al] the information required by the Act and <br />these Rules for the size of operation.
