Cattany <br />Acting Division Director <br />THIS PERMIT is issued by the Mined Land Reclamation Board, Department of Natural Resources, <br />State of Colorado. <br />RECITALS <br />A. The Pemlittee, Prowers County, desires to aondud a mining operation ]mown as Davis Pit, for <br />the purpose of eldracting sand and gravel. The Pemiittee will not mine any secondary commodities at this site. <br />B. On September l6, 2002 the Mined Land Reclamation Board (the "Board") approved the <br />Pemuttee's application for this permit and directed that this pemut be issued opal the filing with the Division of <br />Minerals and Geology (the "Division") of perfomlance wartanty approved by the Division. Said warranty has <br />been filed with the Division. <br />C. If the Permittee desires to extract materials other than those listed in (A), a separate permit may <br />be required. <br />D. On September 16, 2002 the Board made the following findings: <br />1. The application for this pemrit complies with the requiremerrts of the Colorado Mined <br />Land Reclamation Ad for the Extraction of Construction Materials, C.R.S. 34-32.5-101 et sue, as amended, and <br />with all applicable Local, state and federal laws; <br />2. The operation will not adversely affect the stability of any sigllificarrt, valuable, and <br />pemlanent man made strucdlre located within two hundred feet of the Affected Land, exult where there is an <br />agrcement between the Operator and the persons having an irrterest in the structure that damage to the stnrciure is <br />to be compensated for by the Pemvttee; and; <br />
