Boyd, Reclamation Specialist~'~ ~
RE: File No. M-89-120, Platte Valley Pit, Adequacy Items
DATE: March 19, 1990
T0: Mike Applegate
John Doe1•fer and I have reviewed the responses provided on February 20, 1990
to the Division's adequacy concerns. Our comments are provided below. These
are noted according to the numbering system used in the February 7, 1990
adequacy letter.
3. Nave you obtained an agreement with CCWCD regarding use of their ditch
in connection with your dewatering operations and/or relocation of
tFleir wells? If not, please provide additional information regarding
your proposed alternative, particularly the size and location of arty
proposed settling pond(s).
4. The response to the question on whether water has been secured to fill
the proposed reservoir is based on:
(1) The applicant intends to file for junior storage rights for winter
diversions when other senior reservoirs cannot divert because of
ice blockage of their delivery system,
(2) Much transbasin and wastewater effluent is available for the
taking, and
(3) Recent court filings show gravel pits as proposed reservoirs.
Ii; appears that you hold no water rights at this time, and that a
filing has not yet been made fora conditional decree. It is the
policy of the Mined Land Reclamation Board to require an alternative
rf~clamation plan in the application when no water rights are secured at
the time of submittal. The Division recommends that you submit an
alternate reclamation plan and bond for the costs attributable to this
plan if they are higher than the currently proposed bond amount.
