<br /> <br />~._; <br />y Our Division is now in the process of reviewing the application for adequacy in meeting the <br />regulations promulgated under the referenced Act. I will be preparing an adequacy letter for Agile <br />Stone Systems, listing all the items I feel need to be more adequately addressed by them before we <br />can make a decision, (due by October 6th), regarding whether to approve it, deny it, or set the matter <br />for a heazing before [he Colorado Mined Land Reclamation Board (MLRB). If you would like a <br />copy of the adequacy review, please let me know. <br />Your comment letter was sent on to Tom Gast of Environmental Management Services Company, <br />who is the applicant's permitting contact. <br />This application may go through a public hearing process. If so, an Informal Conference would first <br />be scheduled soon after the comment period ends on August 21, 1997. This conference will identify <br />the issues to be considered in the continued hearing process. APre-hearing Hearing Conference <br />would then be held to determine what issues would be heard and what the order of a hearing would <br />be before the MLRB. <br />In my previous letter to you I asked you to let us know whether you aze objecting to issuance of a <br />Reclamation Permit for the Pazkdale Project. If you do object, you will be given party status in the <br />heazing process. You will be notified of the two conferences in any case.
