Dear Mr. Farrar:
Our Division has received the corrected legal description pages for the
financial and performance warranties for the Adams Pit. The new warranty
package for this operation is now complete. Thus, the succession of operators
and transfer of permit for this operation is now effective, and a copy of the
signed document is enclosed. I nave also enclosed two signed originals of an
amended mining and reclamation permit for the Adams Pit which retain the
original permit issuance date of September 9, 1980 but which reference your
company as operator and have an attached legal description for the entire
75.75 acre amended permit area. This amended permit is being issued for
purposes of clarity.
Please have an appropriate officer of Colorado Sand and Gravel sign each
permit, having the signature notarized in each case. Then, retain one permit
for your files and return the other to us within two weeks. As you know, all
of the amendment application materials, as well as any subsequent adeouacy
materials submitted by your company, are considered an integral part of permit
No. M-80-110 and are incorporated by reference. It is presumed that you have
retained a copy of ail of these materials; therefore, none is enclosed with
this mailing.
The issuance of this amended permit to your company_closes the_file foryouur_
Sandy Acres Pit, File No. M-81-159. Therefore, enclosed please find Bond No.
644T632-from the Ameriean Insurance Company in the amount of 513,500.00 and
the Performance Warranty for the Sandy Acres Pit. Both warranties are
released as of February 20, 1986. A11 financial (Bond No. 6413859 from the
American Insurance Company in the amount of 521,000.00) and performance
warranties from Henderson Development Company are also released as of that
date and are being returned to that company with their copy of this letter.
