Box 1647 <br />Greeley, Colorado 80631 <br />RE: Greeley Sand & Gravel, Weld County <br />Our File No. 77-36 <br />Dear Mr. Cowan: <br />After doing research and conferring with the Assistant Attorney General, <br />Lynn Obernyer, it was found that both your operations must be brought in <br />front of the Mined Land Reclamation Board simutaniously. Therefore, <br />your Greeley Sand and Gravel application can be heard at the June 21, <br />1977 meeting, but no action can be taken until both applications ace <br />complete and adequate. The Mined Land Reclamation Board decides iC ,~ <br />Cease and Desist Order should be issued and in the past the Board Itas <br />worked with the operator in bringing them into compliance with the Mined <br />Land Reclamation Act. <br />I recommend you come in front of the Board on June 23, 1977 and explain <br />why you did not come under the compliance plan. <br />August 25 or 26, 1977 would be the earliest date when these applications <br />could be brought before the Mined Land Reclamation Board simutaniously <br />and this depends on when we receive the application for the pit in <br />Fort Collins, Colorado. <br />If you have any questions, do not hesitate to contact me. <br />Sincerely, <br />James L.
