<br />the proposed gravel pi[ is located in the NE1/4 of the NW 1/4 of Section 17, Township 6 North, <br />Range 85 West. <br />Exhibit E -Sand and Gravel Deed: Enclosed is a xerox copy of a Sand and Gravel Deed <br />wherein Mr. Larry E. Glassburn conveyed to Luke J. and Caroline Jean Tellier the mineral rights <br />for the sand, gravel and limestone situated on 160 acres of land in Sections 8 and 17 of Township <br />6 North, Range 85 Wes[. Of particulaz interest is the fact that the sand and gravel rights <br />corresponding to a tract of land containing 80 acres in the E '/~ of the NW 1/4 of Section 17, <br />Township 6 North, Range 85 West was conveyed to Mr. and Mrs. Tellier. The Applicant wishes <br />to point out that all of the lands within [he 40 acres tract of land owned by Mr. and Mrs. Tellier <br />and which corresponds to a tract of land whose legal description is the NE 1/4 of the NW 1/4 of <br />Section 17, Township 6 North, Range 85 West are covered by the above mentioned sand and <br />gravel deed. <br />This information is submitted to show that there is absolutely no question as to the pazcel of land <br />which is the focus of [his gravel pit Permit Application and that the owner of [his pazcel of land <br />clearly owns the sand and gravel mineral rights to this same tract of land. Why the copy of the <br />deed given to the landowner and which was submitted in the original Permit Application stated <br />that this parcel of land was a 40 acre tract of land found in both the SE 1/4 of the NW 1 /4 in one <br />portion of the deed and in four other places in the deed the description is given as the NE 1 /4 of <br />the NW 1/4 of the Section 17, Township 6 North, Range 85 West is not understood. Regardless <br />of why the original deed given to the Landowner and that recorded in the Routt County Clerk's <br />Office are different, the deed obtained from the Clerk's office clarifies the confusion regarding <br />this matter and the Applicant submits that this documentation clearly establishes [he correct legal <br />description and legal right of entry for this parcel of land under consideration. <br />PROXY STATEMENT: Enclosed is a properly notarized statement from Mr. Patrick J. Tellier, <br />one of the parties in this Permit Application, designating Mr. John A. Vanderbloemen, as his <br />agent for [he Hearing before [he Mined Land Reclamation Board to be held on 16 December <br />1998. <br />As required by Section V. Witnesses and Exhibits of the Draft Hearing Order, we aze enclosing <br />copies of the certified mail receipts documenting that we have concurrently mailed copies of this <br />information to all of the pazties listed in Section II.
