<br />Page: 140 <br />Construction Materials Rule 6 <br />Conservation District, to the Boazd of Supervisors of the local Soi] <br />Conservation District, pursuant to Subpazagraph 1.6.2(1)(a)(ri). <br />6.4.18 EXHIBIT R - Proof of dine with County Clerk and Recorder <br />An affidavit or receipt indicating the date on which the application was placed <br />with the local County Clerk and Recorder for public review, pursuant to <br />Subparagraph 1.6.2(1)(c). <br />6.4.19 EXHIBIT S -Permanent Man-made Structures <br />t ts(a)(e) Where the mining operation will adversely affect the stability of any significant, <br />valuable or permanent man-made structure located within two hundred (200) <br />feet of affected land, the applicant may either: <br />(a) provide a notarized agreement between the applicant <br />and the person(s) having an interest in the structure, that the applicant <br />is to provide compensation for any damage to the structure; or <br />(b) where such an agreement can not be reached, the <br />applicant shall provide an appropriate engineering evaluation that <br />demonstrates that such structure shall not be damaged by activities <br />occurring at the mining operation. <br />(c) where such structure is a utility, the Applicant may <br />supply a no[arized let[er, on utility letterhead, from the owner(s) of the <br />utility that the mining and reclamation activities, as proposed, will have <br />"no negative effect" on their utility. <br />6.5 GEOTECHNICAL STABILITY EXHIBIT <br />t tb(a)G) (1) On asite-specific basis, an Applicant shall be required to provide <br />a geotechnical evaluation of all geologic hazards that have the potential to <br />affect any proposed impoundment, slope, embankment, highwall, or waste pile <br />within the affected area. The Applicant may also be required to provide a <br />geotechnical evaluation of all geologic hazards, within or in the vicinity of the <br />affected lands, that may be de-stabilized or exacerbated by mining or <br />reclamation activities. <br />
